These Terms of Use (“Terms”) govern your use of the product website at vizrowipers.com (the “Site” or the “website”), operated by Vizro (“Vizro,” “we,” “us,” or “our”), based in Mississauga, Ontario, Canada.

The Site is informational only, showcasing products. You cannot buy anything on it, there is no checkout, no payment system, you cannot create an account, or subscribe to anything. When you want to purchase a Vizro product, the Site links you to third-party retail sites of PartsAvatar and Amazon where any purchase is governed by their own terms and privacy policies.

1. Acceptance of Terms

A link to these Terms appears in the footer of every page of the Site. When you submit our Contact/Support form, you will be asked to check a box confirming your agreement to these Terms and our Privacy Policy before your message is sent. By using the Site, or by checking that box, you confirm that you have read, understood, and agree to these Terms and applicable federal and provincial laws. If you do not agree, please do not use the Website.

We reserve the right to update or modify these Terms at any time. Continued use of the Site after any such changes constitutes your acceptance of the revised Terms.

2. Permitted Website Use

The Vizro website is an informational platform intended to provide visitors with information about our brand and product lines. It does not offer direct purchasing, shopping carts, checkout functionality, user accounts, or subscription services. We grant you a limited, personal, non-commercial, revocable licence to access and view the Site and its content. You agree not to:

  • Use the Site for any unlawful purpose;
  • Attempt to gain unauthorized access to the Site or interfere with its security or performance;
  • Use bots, scrapers, or other automated tools to access or copy the Site or its content without our written permission;
  • Submit unlawful, harmful, infringing, or misleading content through the Contact/Support form; or
  • Copy, republish, frame, or redistribute Site content except as these Terms allow.

3. Intellectual Property

All content on the Site such as text, graphics, logos, product images, videos, and designs are owned by Vizro, its corporate group, or their licensors, and are protected by copyright, trademark, and other intellectual property laws. All rights not expressly granted are reserved. If you believe content on the Site infringes your copyright, you may send a written notice. Please notify us through support@vizro.ca by identifying yourself, the work, and the location of the allegedly infringing material in your communication.

4. “Where to Buy” Links

The Site links to third-party retail sites where Vizro products are sold, including PartsAvatar and Amazon. Purchases on those sites are made with those retailers, under their terms of sale, return policies, and privacy policies, not ours. We are not responsible for order fulfillment, shipping, returns, or the content or practices of external websites.

5. Product Information and Safety

Product descriptions, specifications, and images on the Site are provided for general information and may change without notice.

Vizro products are automotive wiper blades. If installed or used incorrectly, they may fail to perform as intended, reduce visibility while driving, or scratch or damage your windshield. Always read and follow the installation instructions and safety warnings included with your product before use. The Site is not a substitute for the product instructions.

Nothing in these Terms excludes or limits any statutory or implied warranty, condition, or right relating to a product you purchase that cannot be excluded under applicable consumer protection or sale-of-goods law, including the legal warranties under the Civil Code of Québec and Quebec’s Consumer Protection Act. The disclaimers in Section 7 apply to the Site only, not to our products.

6. Privacy

Our Privacy Policy explains the limited information we handle through the Site including our use of Google Analytics with your consent and is incorporated into these Terms by reference.

7. Site Provided “As Is”; Limitation of Liability

The Site and its content are provided on an “as is” and “as available” basis. To the fullest extent permitted by applicable law, we make no warranties about the Site, express or implied, and we will not be liable for indirect, incidental, special, or consequential damages arising from your use of (or inability to use) the Site.

Nothing in these Terms limits or excludes liability that the law does not allow to be limited or excluded. In particular, we do not exclude or limit liability for bodily or moral injury (Civil Code of Québec, art. 1474), for our intentional or gross fault, or for fraud; and nothing in these Terms limits any product liability rights or consumer protection rights you have under the law of your home jurisdiction.

8. Governing Law and Where Disputes Are Heard

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there, except that this does not deprive you of mandatory consumer protections of your home jurisdiction. You and Vizro agree to the non-exclusive jurisdiction of the Ontario courts. Quebec residents retain the right to proceed before Quebec courts under Quebec law (Civil Code of Québec, art. 3149; Consumer Protection Act, ss. 11.1 and 19), and consumers elsewhere including in the United States, retain any non-waivable right to bring proceedings in their home jurisdiction.

9. Changes to These Terms

We may update these Terms from time to time. The updated Terms will be posted on this page with a revised “Last updated” date, and your continued use of the Site after they are posted constitutes your acceptance of them. We encourage you to review this page periodically.

10. General

If any provision of these Terms is found unenforceable, it will be limited or severed and the rest remain in effect. These Terms and the Privacy Policy are the entire agreement between you and us about the Site. Our failure to enforce a provision is not a waiver of it. We may suspend or terminate access to the Site to protect the Site or our rights.
